기존의 각종 법률에서는 해상운송과정에서의 화물의 안전이나 선박 자체의 안전 혹은 선박 항해의 안전에 관한 규정을 둠으로서 화물의 안전을 도모하는 수준에 그치고 있다. 물류관련법령들을 살펴보면 물류에 관한 기본정책이나 물류안전을 위한 추상적인 기준들이 각종 법률에 산발적으로 규정되어 있을 뿐이다. 따라서 물동량이 가장 많은 항만에서의 물류안전에 대한 관리책임을 맡는 담당 정부기관이 어디이고 어떤 역할을 담당할 것이며, 항만의 소유자나 물류작업종사자는 구체적으로 항만물류의 안전을 위해 어떠한 일을 해야 할 것인지에 관한 구체적인 규정을 단일법전에 담을 필요가 있다. 정부조직법의 개편 전에는 육상운송ㆍ해상운송ㆍ항공운송을 모두 前국토해양부에서 관장하고 있었지만, 현행 정부조직법에서는 육상ㆍ항공운송은 국토교통부가 항만ㆍ해상운송은 해양수산부가 담당하게 되었다. 따라서 항만물류안전에 관한 관리업무는 해양수산부가, 다른 육상ㆍ항공물류안전에 관한 관리업무는 국토교통부가 관장하게 되어 물류안전에 관한 정부의 관리업무가 이원화 될 수밖에 없다. 그러나 물류의 안전확보라는 측면에서 보면 물류업무를 두 개의 정부기관에서 이원적으로 담당하는 것보다는 하나의 정부기관에서 이를 담당하는 것이 효율적임은 두 말할 필요가 없다. 이 논문에서는 보안문제는 별론으로 하고, 항만물류안전을 확보하기 위한 방안과 법률(안)을 제시한 것이어서 법률(안)의 명칭도 가칭 '항만물류안전 및 보안에 관한 법률(안)'이라고 하였다. 그러나 물류운송수단이나 구간에 관계없이 물류안전의 확보에 관한 단일법을 제정하고 그 법률(안)에 항만물류ㆍ육상물류ㆍ항공물류ㆍ복합물류 등으로 세분화된 규정을 두어 종합적인 체계를 구출하는 것이 바람직하다고 생각한다. 그렇게 하더라도 가칭 '물류안전 및 보안에 관한 법률(안)'을 운용하는 정부기관은 여러 곳일 수밖에 없는데, 이는 정부조직법의 개편이 초래한 부득이한 결과가 될 것이다. 이 논문에서 제시한 틀에서 법률(안)을 구성한다면 가칭 '항만물류안전 및 보안에 관한 법률(안)'은 가칭 '물류안전 및 보안에 관한 법률(안)'에 포함되어야 할 것이다. 보다 구체적이고 자세한 법률(안)의 내용을 완성하는 것은 앞으로도 상당한 시간을 필요로 하는 일이다. 우선 가칭 '항만물류안전 및 보안에 관한 법률(안)'을 보강하기 위해서 국내무역항은 물론 항만선진국들의 무역항에서 이루어지는 물류안전관리에 관한 실태조사가 보완되어야 할 것이다. 이를 토대로 문제점을 보다 심층적으로 분석하고 그 대책을 마련하여 하위법령을 마련하는 노력이 뒤따라야 할 것이다.
Abstract
The current law of South Korea promotes safety of cargo by stating safety requirements on cargo, ships and navigation at sea. On logistics, basic policies and safety regulations are stated in abstract clauses scattered over various acts. It is necessary to bring together all clauses on logistics safety at ports in a single, integrated code to designate government departments in charge and their specific roles as well as the roles of different related agents such as port owners and employees in the industry. Transportation by land, sea and air, which were all under the former Ministry of Land, Transport and Maritime Affairs, are now under two different ministries after the 2013 government restructuring. The Ministry of Land, Infrastructure and Transport are in charge of land and air transportation while the Ministry of Ocean and Maritime Affairs takes care of transportation at sea. However, the one-ministry system is much more efficient in securing logistics safety. The thesis proposes the tentative “Act on Port Logistics Safety and Security” which brings together all related clauses on logistics by sea, land, air and multi-modal combination of these in a single code. The different means of transportation will be dealt in separate sub-sections within the code. Even with the new code, the different means will be under different ministries, which is inevitable under the restructured government system of South Korea. If the proposed framework is used, laws on port logistics safety and security will be under the tentative “Logistics Safety and Security Act.”While completion of the act will take time, an in-depth research on port logistics safety in advanced countries must precede. Such research will be used as a basis of the specific clauses under the new logistics safety law.
