감염병의 예방 및 관리를 위한 지방자치단체의 역할과 법정책적 과제

‘코로나바이러스감염증-19’의 확산세가 지속되면서 감염병의 예방과 관리를 위한 지방자치단체의 역할이 중요하게 대두되고 있다. 지방자치단체는 지역 차원에서 드라이브스루 내지 워킹스루 방식의 진료소를 설치하고 관할 내 생활치료센터를 마련하는 등 적극적인 정책 추진으로 감염병의 대응에 성과를 보인 바 있고, 이는 전국적으로 타 지방자치단체에서의 유사한 정책으로 확산되기에 이르렀다. 하지만 이러한 지방자치단체의 노력에 비해 현행 법제 및 정책적인 측면에서 지방자치단체의 감염병 대응 권한이 충분히 확보되고 있다고 보기는 어려운 실정이다. 메르스 이후 여러 부분에서 지방자치단체의 감염병 대응 역량이 강화되었으며 여전히 감염병의 대응에 관한 지방자치단체의 권한 강화의 필요성이 인정됨에도 불구하고, 관련 법정책에서는 아직도 여러 가지 문제가 해결되지 못하고 있기 때문이다. 이에 본 연구에서는 법정책학적 관점에서 지방자치단체의 사무 배분 등에 대한 법원칙과 메타거버넌스 이론을 살펴보고, 지방자치단체의 감염병 대응 권한 강화를 위한 몇 가지 쟁점에 대한 검토를 진행하였다. 중앙정부와 지방자치단체 권한의 구분 및 명시, 감염병 대응 인력 관련 지방자치단체의 권한 확대, 지방자치단체의 역학조사 권한 확충, 지방자치단체가 참여하는 조정 기제의 제도화 등을 중심으로, 본 연구는 지방자치단체의 감염병 대응 역량 강화를 위해 한시적 의료인력 확보 권한 부여(감염병의 예방 및 관리에 관한 법률 제60조의3), 역학조사관 교육･훈련 권한 확대(동법 제18조의3), 역학조사 시행을 위한 자료제출 요청 권한 법제화(동법 제18조의4), 지방자치단체의 역학조사 권한 확충(동법 제18조의2), 지방자치단체 참여 협의체의 법제화에 관한 규정의 신설을 제안하였다.
Abstract
As the spread of Coronavirus Disease (COVID-19) continues, the role of local governments in the prevention and management of infectious diseases is becoming important. Local governments have shown results in responding to infectious diseases by actively implementing policies such as setting up drive-through or walking-through testing centers and establishing life treatment centers in their jurisdictions. However, it is difficult to say that local governments have sufficient authority to respond to infectious diseases in terms of current legislation and policy compared to the efforts of local governments. Although local governments have strengthened their ability to respond to infectious diseases in many areas since MERS, and the need for local governments to strengthen their authority to respond to infectious diseases is still recognized, many problems have not been solved in related law policies. In this study, from the viewpoint of legal policy, the legal principles for the division of authority between the central government and local governments and the theory of meta-governance were examined, and several issues were reviewed to strengthen local governments’ authority to respond to infectious diseases. The issues include distinguishing and specifying the authority of central and local governments, strengthening the authority to mobilize human resources necessary to respond to infectious diseases, expanding the authority of local governments for epidemiological investigation, and institutionalizing a coordination system involving local governments. For each issue, this study suggests revised article propositions on Temporary Duty Orders (Article 60-3), Fosterage of Personnel for Epidemiological Investigations (Article 18-3), Requirement for Presentation of Materials and Other Relevant Matters (Article 18-4), Request for Epidemiological Investigations (Article 18-2). It also proposes for a new article on a body of consultation involving local governments.
