Abstract

Korea has amended Copyright Act on December 2011. Art. 125-2 of amended act provides statutory damage award reflecting the civil enforcement of copyright in 'KOR-US FTA'. The statutory damage of new act is hybrid type of the U.S and China's model. Some negative perspective against amendment is feasible as statutory damage is heterogeneous to conventional regime of Korean tort law. Plus, it intensifies the critical view that judges are already allowed to exercise their discretion for damage amount under co-existing provision of Art. 126. However, it is desirable for the courts to keep positive stance for statutory damage utilizing it as a new measures to protect the digital copyright holders. Statutory damage can deter the potential infringement and possibly be a policy leverage resolving the indirect infringement issues of multi use technologies as well. In international perspective, the consensus that statutory damage may be a useful scheme for copyright enforcement is being established. In addition, continental law jurisdiction countries having been negative for statutory damage system are in transition signing Anti Counterfeiting Trade Agreement which requires to adopt statutory damage options against copyright infringement. The analysis of court cases on damage awarding discretion(Art. 126) manifests the courts have been rather passive on this issue by now. More active attitudes are proposed in practicing the statutory damage provision to maximize its merit in the future. At the same time, noting that statutory damage has its own potential of side effects is important. To avoid these side effects, it is prudent to refer to some negative experiences of the U.S. - the most famous patron of statutory damage system- legal practice and recent academic discussions over related issues. Judges are required to interpret Art. 125-2 elements to accord with Korean legal practice than unconditionally following the U.S. Copyright law's understanding.
