초록

Abstract

In this article, I first examine in every detail the differences between the statutes in Criminal Code of Korea related with computer crime and the statutes in the Information Network Act of Korea related with network crime. Then, I present a doctrinal analysis regarding the interpretation of network trespass in Information Network Act. I propose that courts should limit network trespass as access to network that invalidates or circumvents code-based restrictions. The constitutional void-for-vagueness doctrine would help in delineating the proper scope of criminal liability when applying the Information Network Act. By means of this process, the network trespass will completely “metamorphose” into normal sanctions that delicately balance competing interests between owners of networked computer systems and users and draw a bright line between permissible and forbidden uses.
