Abstract

Recently, the social calling for adoption of class action as an solution for mass victim tort cases has been rising. However, the weak performances and struggling of securities class action which is only feasible class action in Korea by Class Action in Relation of Securities Act gives doubt to the workability to the class action as real remedy for mass victim torts in Korea. This article introduces about current status of Public Compensation(hereafter "PC") of independent agencies in U.S. which is regarded as the champion of class action, focusing on the Case of the U.S Securities and Exchange Commission(hereafter "SEC"). PC is one of arising remedies for replacing or complementing class action in U.S. This article follows the historical evolutions and current status, categories for application, relations and preclusion effects of PC with class action. Also, this article explains how SEC organize so called the Fairness Funds which is composed of disgorgement and civil fines and delves into the actual effect and components of SEC's success in PC in comparison with class action. Though PC has evolved in U.S which has peculiar judicial system and system in comparing with Korea, it has relatively good potentials for mass victim tort cases in Korea in comparing with class action and the adoption of it should be considered.
