교회 분열로 인한 재산권 분쟁의 교회법적 해결 방안에 관한 소고

Abstract

This study is an attempt to proper resolutions for church property disputes in the context of church split. Realistically, since most of church bring the cases of church property disputes to the civil court, therefore a researcher will review the existing precedents of civil court. The next chapter, the discussion will examine what is told by the Bible on the resolution by civil court for the church disputes, then a researcher will move on the issue of how we understand the resolution in theological perspective. Finally, I will review the precedents and theories of United States and the presbyterian church law(PCUSA), and then will draw up plans that draft legislation to prevent property disputes in the church by law and the denominational constitution, the establishment an organization for conciliation and arbitration, the reasonable resolution for church property disputes by the church court. Consequently, as we apply the standards of the Bible to disputes in the church, it is urgent task for christians to seek reconciliation preferentially, then we should modify the church law in order to resolve the disputes reasonably within the church law.
