대학은 학문탐구활동은 물론이고 대학생들의 생활이 보다 안전해지도록 최선의 환경을 만들어 주어야 한다. 현재의 지엽적인 안전대책이나 사후 대응중심의 안전프로그램으로서는 날로 증가하는 캠퍼스 내의 각종 범죄와 비행에 적절하게 대처할 수 없다. 일반 경찰의 도움을 구하고 경찰의 출동에 의한 문제해결방식은 대학의 자율성을 위협할 수도 있고, 범죄문제에 효과적으로 대응하는 수단이라고 할 수 없다. 규모가 큰 대학의 경우에는 학생의 수가 지역사회의 인구보다도 많은데, 이 경우에 대학의 모든 범죄와 비행행위를 지역경찰에 일임할 수는 없다는 것도 대학이 가지고 있는 특수성은 물론 수익자부담의 원칙과도 무관하지 않다. 캠퍼스 폴리스가 도입된다면 반사적으로 지역경찰의 부담은 줄어들고 치안의 사각지대가 치안의 중심지역으로 부상하게 될 것이다. 캠퍼스 폴리스 도입을 위해 당장 ‘청원경찰법’을 활용할 수 있다. 동법에서는 ‘학교’등 육영시설도 청원경찰의 배치를 신청할 수 있는 시설로 규정하고 있기 때문이다. 이 경우 캠퍼스 폴리스는 ‘캠퍼스’라고 하는 특정한 관할구역에서 경찰관직무집행법상의 권한을 보유하고 경찰관의 역할을 수행할 수 있을 것이다. 현재 청원경찰을 대학 캠퍼스에 배치하고 있는 대학은 없다. 적지 않은 인건비가 소요되기 때문이다. 하지만 최근 대학정보공개법의 시행에 즈음하여 공개대상이 되는 대학정보에 ‘캠퍼스의 안전조직’과 ‘캠퍼스 범죄율’을 포함시킨다면 상황은 크게 달라질 것이라고 본다. 미국은 Clery Act를 시행한 이후에 다수의 대학이 경찰관의 권한을 보유한 캠퍼스 폴리스를 채용하여 캠퍼스 범죄에 대처하여 범죄율을 낮추는 성과를 보이고 있다. 범죄학적으로도 범죄자의 가장 많은 비중을 차지하는 20대 전반의 청년들이 밀집하여 범죄의 우려가 다분한 대학사회에 캠퍼스 폴리스 제도를 도입하게 된다면, 범죄예방은 물론 수익자부담의 원칙을 대학사회에도 관철하게 되고 나아가 경찰업무의 민영화를 통해 경찰인력의 불필요한 누수를 줄일 수 있을 것이다. 또한 경찰력의 효율적인 운용에도 도움이 되는 효과를 거둘 수 있음은 물론, 지역사회 경찰활동의 내실화를 도모하고 대학사회가 법의 준수를 통한 경찰친화적인 분위기가 형성되고, 종국적으로는 안전한 캠퍼스를 만들어서 보다 나은 대학교육환경을 조성하는데 기여할 것이라고 본다.
Abstract
As a result of the domestic violence and mass civil disturbances, campus security often proved ineffective against riots and other violent civil demonstrations, occasionally resulting in injury to both the students and the officers. So, a "security" department possessing no real law enforcement authority is going to be not sufficient for most modern colleges and universities sooner or later in Korea. The University must have taken measures to provide the safest possible living and learning environment. University Safety programs and private alarm systems cannot be fully effective against crime without campus police that the university community has designed to protect itself. It is common in the United States for a major university to have its own police force. Full service law enforcement agencies in campus environments have proven to be a functional solution to many of the problems that had resulted from the previously poorly managed security forces. We believe this special police adds value to the enhanced communication and sharing critical to the safety and security of the students, faculty, staff and guests of university. Many institutions are able to employ officers who were granted full police powers via deputization by local authorities or by Private Police Act. The Authority of campus police is needed to be similar to the public police in campus(jurisdiction) in Korea. The jurisdiction of campus police departments has to be limited to campus property, but may also include property and roadways adjacent to the campus. University and college should combine both diplomacy and authority in ruling the campuses and maintaining their scholastic standards and environment. Introduction of campus police system will be able to be an answer.
