별정 MVNO 사업자의 이용약관 : 이용자 보호와 도매제도 활성화를 위한 정책방안

초록

본 연구의 목적은 2012년 2월 전기통신사업법 시행령 제31조(등록 또는 신고 사항의 변경) 제6호(이용약관)의 신설에 따른 별정 MVNO 사업자의 이용약관 정책방안을 이용자 중심에서 제시하는 것이다. 2012년 7월 현재 한국 전기통신사업법은 법제28조제1항에 따라 기간통신사업자는 ‘서비스별 요금 및 이용조건(서비스별 이용약관)’을 방송통신위원회에 신고하거나 인가를 받으며, 시행령 제28조에 따라 별정통신사업자는 등록시 이용약관을 방송통신위원회에 제출하도록 하고 있다. 그러나 현행 소매부분의 서비스별 이용약관 정책은 별정 MVNO 사업자의 이용자 불만감소와 권익보호, 그리고 최근 현안이 되고 있는 망 중립성, mVoIP, MVNO, 선불요금제, 단말기자급제 및 번호이동성의 도매제도 활성화를 위해서도 적절하게 기여하지 못하고 있는 상황이다. 따라서 본 논문은 법제28조제1항 본문의 ‘서비스별 요금 및 이용조건(서비스별 이용약관)’을 ‘요금제별 서비스 및 이용조건(요금제별 이용약관)’으로 개정, 시행령 제28조관련 별정통신사업 등록요건의 이용약관 내용에 요금제별 이용약관 포함, 표준화된 요금제별 이용약관 기준마련, 및 요금제별 이용약관 가이드라인의 필수기재 내용 포함 등이 필요함을 제안하고 있다.

Abstract

This study is designed to present the policy strategy of the terms and condition for MVNO (mobile virtual network operator) from the viewpoint of users, in accordance with paragraph 6 (terms and condition of service), article 31 (modification of matters of registration or report), the enforcement decree of the telecommunications business act, which was newly established in February 2012. As of July 2012, article 28.1, the telecommunications business act in Korea requires that all carriers “should report the service charges and the terms and conditions of use for each service type (terms and condition by service) to the Korea Communications Commission (KCC), or obtain authorization from the KCC”. Article 28, the enforcement decree, stipulates that MVNO should submit the terms and conditions of the service to the KCC when registering their business. However, the policy of terms and condition by service in the retail sector cannot make a proper contribution to the promotion of network neutrality, which has recently become a more prominent issue, including through mVoIP, MVNO, a prepaid system, and wholesale system promotion of the terminal self-sufficiency system and number portability. Therefore, this paper proposes the necessity of changing the “service charges and the terms and conditions of use for each service type (terms and condition by service),Article 28.1, Telecommunications Business Act” to “service and use agreement by rate system (terms and condition by rate),” so that the use agreement contents in the registration requirements for the special category telecommunications service, which related to article 28, the enforcement decree, include the use agreement by rate system, preparation of use agreement standards by rate system, and required information of the use agreement guidelines by the rate system.
