Abstract

This paper seeks to present the possibility of restoring democracy from its crisis by investigating the politics of tragedy in William Shakespeare’s Hamlet. Carl Schmitt, one of the major influences on constitutional theory, claims that the mythic tragedy of Hamlet is attributed to the taboo of the Queen and the hamletization of the avenger in his book, Hamlet or Hecuba. Long neglected due to his complicity with the Nazis, Schmitt has for the past decade drawn much attention to his theory of sovereignty and a state of exception, in particular, regarding Hamlet. Yet it is problematic to apply Schmitt’s theory of sovereignty to the analysis of Hamlet since modern sovereignty has yet to emerge at the end of the Tudors. This paper calls into question Schmitt’s accounts of the taboo of the Queen and the hamletization of the avenger as crucial vehicles for explaining the tragic greatness of Hamlet, suggesting the very limits of Schmitt’s historical approach. More importantly, Schmitt’s theory of sovereignty and a state of exception in accounting for Hamlet indeed contradicts his own perspective demonstrated in Hamlet or Hecuba. At the heart of Hamlet and his tragedy is the possibility of opening up new interpretations not only from the Renaissance audiences but also from the contemporary audiences. Hence, this paper attempts to explore a significant role that Hamlet plays in shaping the perspective for jurists who are fundamentally influenced by Schmitt. For this reason, we critique and deconstruct Schmitt’s ‘concept of the political’ and his interpretation of Hamlet as the intrusion of historical events into aesthetic representation of such political figures as James I and Mary Stuart. In so doing, we pursue to reinterpret the concept of the political which is, for Schmitt, grounded in the antagonism of friend and enemy. Instead, we suggest a solution to the crisis of democracy that is contingent upon the failure of truth telling and the problems of disgust and hatred, thus pointing to the prospect of revitalizing modern democracy. We argue that Schmitt’s concept of the political fails to provide a proper alternative to Hamlet’s dilemma; consequently, Hamlet ends up with tragedy as a result of his failure of parrhesia in Michel Foucault’s terms and his immersion in disgust and hatred toward Gertrude and Ophelia. To be precise, Schmitt’s concept of the political is opposed to democratic politics which supposedly encourages individual citizens’ practices of fearless speech and conscientious thinking except for disgust and hatred. Thus, Schmitt’s concept of the political is destined to fail especially because of his collusion with the Nazis in their totalitarian jurisprudence, which culminates in the extinction of a certain ethnic group, that is, the Jews. Therefore, it is compelling to create a key to understanding the concept of the political first and then construct a sound viewpoint on modern democracy. Both Hamlet’s tragedy and Schmitt’s failure urge us to strive for fearless speech and truth telling according to an individual citizen’s conscience without being trapped in disgust and hatred that result from betrayal prevalent on the stage of politics. It is likely to tame the violence of political struggles only insofar as we remain alert to danger inherent in the concept of the political and its practices. Hamlet’s comparison of the world to a stage and human beings to actors inspires us to play a protagonist on the political stage of democracy without lingering as a mere supporting player. That is one of the ways in which each individual citizen constitutes democracy now as an autonomous subject.
