본고는 2007년 7월 1일 시행된 비정규직법의 고용효과를 분석한다. 고용보호법제 도입의 순 고용효과는 이론적으로 분명치 않으므로 실증분석을 통해 확인할 수밖에 없다. 본 연구는 한국의 비정규직법이 55세 이상 연령층을 법 적용에서 제외하고 있음에 착안하여 이를 비교집단으로 사용하는 한편, 이중차분법과 회귀불연속 모형을 결합한 실증모형을 분석에 사용하고 있다. 회귀 결과는 회귀불연속 모형에서 할당변수(assignment variable)인 연령의 범위를 임계값(cutoff value)에 얼마나 근접하게 할 것인가에 따라 민감하게 반응하였다. 이러한 민감성을 염두에 두면서, 가급적 임계값에 근접한 자료들을 분석에 사용하는 것이 바람직함을 고려하면, 비정규직법의 고용효과는 부정적인 것으로 추정된다. 직접적인 법 적용 대상자인 (준)기간제의 고용뿐 아니라, 특히 정규직 고용에 매우 부정적이며, 임금근로 전체의 고용에도 부정적이다. 반면 비정규직 고용은 초기에 부정적인 영향을 받으며, 시간 경과에 따라 풍선효과를 보이기도 한다. 이러한 결과들은 현행 비정규직법의 부작용이 매우 크므로 이를 최소화하려는 노력이 필요함을 시사할 뿐 아니라, 시장과 괴리되지 않는 법과 제도의 중요성을 함축한다.
Abstract
We investigate the effects of the Acts protecting nonstandard workers on employment, which have been enforced since July 1st, 2007. Taking notice of that workers aged over 55 are not subject to the Acts, we use this group as a control one and do the regression analysis combining the method of difference in difference with the regression discontinuity design. We find that the Acts affect negatively workers' employment although the results are sensitive on ranges around the cutoff age. The Acts decrease the employment of fixed-term workers, nonstandard workers, standard workers, and whole employees.
