초록

By reviewing past and current case law as well as leading publications in the field and the current legal situation, this paper aims to examine the current legal status and possible legal protection of climate change migrants. After outlining how climate change functions as a migration driver, the paper then proceeds to explaining the necessity for a legal solution for this issue. This is followed by an evaluation of possible legal solutions, including the Geneva Convention and Human Rights systems, on a global and regional level which concludes that a multilayered approach on the regional, national and international level would serve as the most ideal solution. However, the lack of political will makes the implementation of this approach highly unlikely.
