초록
Due to globalization, any country can become a party to an investor state dispute settlement (ISDS) case. Due to lack of insight regarding global standards, the host country, by the use of illegal and unfair measures, may foster conditions that create investment disputes. Regarding ISD cases, there are many arbitration agencies; the spectrum of the investment norms in question are highly diverse, and most issues are related to finding and verifying facts. Currently, the stage of corporate activities is expanding beyond the domestic market to overseas markets; consequently, being trapped within the closed framework of the continental law system may restrain South Korea’s industrial growth potential in the global market. Thus, this study reviews the “Fair and Equitable Treatment” in ISDS cases from the perspective of the new rules of law and the new global administrative law scholarship.
