초록
The topic of the present article is legal transfer. The term shall be understood broadly here as covering every incidence in which the existence of a legal norm in one legal system has contributed to the emergence of a similar norm in another system. The main claim of this article is that more scholarly attention is warranted in order to properly understand this phenomenon and to guide the related practice. The present text is programmatic in that it substantiates this claim in but a summary fashion (section I), and in that it focusses, instead, on mapping out both, the concept itself (section II) as well as potential directions for future research (section III). It draws on academic discourses that are – just like the author’s own work – mostly “Western” in their frames of reference. Its publication here is meant to be a step towards overcoming this confinement.
