Abstract
A essential patent is a collection of patents that must be infringed if the standard is implemented because it is designed so that the standard cannot be implemented without infringing on the patented technology to implement the contents described in the standard. Therefore, if a patent is recognized as a essential patent, it has the advantage of making it easier to prove infringement and generate profits when the standard technology is implemented. In view of the fact that stable royalty income can be generated through essential patents, major patent countries are making steady efforts to register essential patents. In this study, we looked at the technical and economic values of essential patent where global competition is fierce. To this end, 43,058 US, Chinese, European, Japanese, and Korean IP5 essential patent (declared patents) provided by KISTA (Korea Intellectual Property Strategy Agency) and 428,910 general patents in similar technologies were compared for efficiency. Using the data envelope analysis (DEA) methodology, the efficiency of essential patent and general patents was compared and analyzed over time, and the technical efficiency of essential patent in five countries, including the US, China, Europe, Japan, and Korea, was also examined. As a result of the analysis, it was analyzed that the technical and economic efficiency of essential patent was higher than that of general patents, and it was confirmed that the efficiency gap was decreasing after 2010, when the number of essential patent began to increase rapidly. In the comparison of essential patent patent efficiency between countries, it was analyzed that US essential patent showed high efficiency, and in the case of Korea, it was confirmed that the efficiency of essential patent registered after 2016 has increased relatively after staying at the bottom until 2015. In the case of Korea, it seems that it is time to pursue quantitative growth through support for essential patent, but at the same time, a careful management policy to prevent a qualitative decline in registered essential patent seems necessary.
