호주와 스페인의 예를 통해 본 가정폭력 피해자 정보 공유와 제언

코로나 19로 인한 봉쇄는 역설적으로 가정폭력의 증가로 이어졌다. 집안에 머무르는 시간이 길어질수록 가정 내 갈등과 폭력이 빈번해진 것이다. 이미 우리 사회에서는 가정폭력의 심각성을 인식하고 있으며, 피해자 지원을 위하여 가정폭력 피해자 정보를 협업하는 기관 간 공유할 필요가 있다는 의견이 제시되어 왔다. 그러나 가정폭력 사안의 경우, 피해자의 거주 정보 노출로 인한 보복범죄의 우려가 있는 것이 사실이다. 본고에서는 가정폭력 개념과 현황을 살피고, 가정폭력 피해자 정보 공유 제도를 시행하고 있는 호주와 스페인의 예를 검토하였다. 이후 정보 공유에 전제되어야 할 몇 가지 제안을 제시하였는데, 피해자의 동의를 전제로 한 정보 공유, 통합적인 법률 정비를 통한 체계적인 정보 공유 시스템 마련, 가정폭력에서 가족 관계의 개념 확대, 가정폭력 관련 다기관 협력의 활성화 방안 모색, 무분별한 정보노출 주체 제재 및 보복범죄에 대응한 피해자 보호 규정, 보복범죄 방지를 위한 피해자 ‘대체 주소’의 부여이다. 생각건대, 피해자 정보의 보호와 공유의 조화를 이루는 방안을 모색해야 할 것이다. 더불어 정보공유주체의 정보보호 노력과 신뢰 구축이 수반되어 할 것으로 보인다.
Abstract
The lockdown caused by Covid-19 has led to an increase in domestic violence. There are ongoing requests to share information on victims of domestic violence for cooperation among multi-agencies related to domestic violence. However, there is indeed concern about retaliatory crime for exposing victim information. In this paper, I reviewed the definition of domestic violence and the cases of Australia and Spain, which have been implementing the information sharing system of domestic violence victims. In addition, I made some suggestions that shoud be premised on victiom information shring. Above all. it shoud be based on the consent of victim. The right to safety of vicim is parmount. There should be a balance between sharing victim information and protecting victim information. Also, the information-sharing entities that handle and share information need to make efforts to protect victim information and prevent indiscriminate information exposure.
