中国建设用地立法改革的关键是缩小征地范围，允许集体建设用地流转，建立城乡统一的建设用地市场。改革存在“折中”与“激进”两条路径，“折中”路径对入市土地范围和土地流转用途限制过严，不足以撬动城乡统一的建设用地市场；“激进”路径才代表中国建设用地改革的未来。集体建设用地流转可能引发一系列风险，但通过集体建设用地流转的制度设计，并完善相关配套制度，可以化解改革风险，确保改革目标实现。
Abstract
The key parts of China’s construction land legislative reforms are to reduce the scope of land expropriation, legalize the circulation of collective construction land and establish the integrated construction land market between urban and suburban regions. The “electric approach” and “aggressive approach” are two ways for the reform. The “electric approach ” restricts the scope of land entering market and the purpose of land circulation too much to leverage the integrated construction land market between urban and suburban regions; it is the “ aggressive approach” that represents the future of China’s construction land reforms. The circulation of collective construction land may bring out a series risks but it can dissolve the risks and ensure the realization of the reform objectives through designing the system of the circulation of collective construction land and improving related ancillary systems.
