이 글은 현대 현대 중국의 헌법과 하위 법률이 재산권을 어떻게 다루어 왔는지를 분석하고 있다. 개인의 재산권에 대한 보호․보장은 시장 참여자의 경제활동의 적극성을 유인하는 가장 중요한 제도이라는 점에서 ‘사회주의’ 중국에서 재산권이 제도적으로 어떤 위상을 점해 왔는지를 분석하는 작업은 중국의 지속적 고성장, 시장화의 심화, 개인의 권리의식 변화 등을 이해하기 위해서 매우 중요하다. 이 목적을 위해 이 글은 주로 <헌법>의 진화과정 속에서 비국공유 경제와 개인의 재산권 어떻게 취급되어 왔으며, 헌법의 정신을 계승하고 구현하기 위해서 하위 법률이 어떻게 진화해 왔는지를 추적하는데, <헌법>과 분석 대상은 <물권법>까지로 한정한다. 이 글은 특히 현행 헌법에 대한 4차 수정인 2004년 수정 헌법에 이르기까지 중국의 헌법이 정치경제 상황의 변화와 인민의 요구에 따라 어떻게 대응해 왔는지, 그리고 민법의 핵심을 이루는 2007년의 <물권법>에서 비국공유경제의 지위와 재산권이 어떤 위상을 점하게 되었는지를 통해 중국에서 재산권 보호․보장 수준과 그 현실적 한계를 함께 추적하고 있다.
Abstract
This paper argues the evolution and limitations of law for protecting property rights in PRC since 1949. In arguing the issue, this paper focuses on analyzing the main contents of the material property rights of PRC as well as the meaning of the constitutional law amended in 1999 and 2004 in view of protecting and guaranteeing property rights. Since the beginning of reform and opening-up policy, the position of nonpublic-owned economy in constitutional law of PRC has been lifted up step by step according to the advancement of marketization. After three years of the amendment of constitutional law in 2004, at last, the material property rights law, for protecting the individual material property and the state-owned property equally, has been initiated in 2007. But, in spite of the 25 year-old reform history, private property rights, esp. pertaining to property rights of the real estate still is not clear, and level of protecting property rights is in its first stage. That’s because there have been incessant critics from the conservatives. According to the marketization procedures are approaching the high stage, and procurement of WTO membership, CCP is forced to temporizing its party regulations. In addition, CCP and Chinese Government could not but initiate the very material property rights of PRC. The division of property rights, however, is still ambiguous and the level of protecting of property rights is yet low.
