Abstract
Legal Approach to Contract-based Theory for the Use and Protection of Personal InformationBae, Daeheon The computerized networks of data bring us advantage and disadvantage. While the availability of general information helps us to coordinate others, unauthorized access to personal information of others would deprive his and her financial benefits and/or lose one's privacy. The existing mandatory solution(plus torts approach) sets up centralized data protection rules, and tort(s) law of privacy. The inflexible nature of the existing solution might render the market inadequate to deal with the fluid nature of the information(or data). A contractual framework approach could give individuals(legally ‘information subjects’) the power to choose legal status and then control one's personal information. This article argues that a contractual framework would be better approach to get the use and protection of personal information altogether. Part Ⅰof this article introduces legal problems for access and use of personal information in virtual reality, part Ⅱ discusses the insufficiency from the existing mandatory solution and tort(s) approach with respect to the protection of personal information. Part Ⅲ argues the three bills which could rebuild legal system for personal information in Korea, part Ⅳ describes legal bases for a contractual framework approach within both the contractual theory and related telecommunications laws in Korea, lastly this article concludes that a contractual framework approach would be better methods, balancing the information subjects' desire for protection against unauthorized access and the benefits from the information economy.
