Abstract

Change and Its Legal Issues on the Finance and Banking System in North Korea Shin, Hyun-Yoon Recently, North Korea has re-organized legal system of finance and banking to cope with the changes of economical environment. The re-organization of finance-banking system is one of the effort to manage the insufficient foreign currency efficiently and to overcome the financial problems which have come from the change of financial environment after the 1990s, specially after 7.1 economy management improvement. One of the most important change is the enactment of the act of commercial bank. The act provides that the commercial bank can manage its activity and budget by itself. According to the act, banking system is changed from mono-banking system in which a bank cover the function of central bank and commercial bank to two-tier banking system in which the function of central bank and commercial bank is divided. Therefore, the central bank will manage only its own function, issue and control of currency. The nation will control the other banks including the commercial bank through the central bank indirectly. For the two-tier banking system to result in sucess, more specific improvement plan should be drew up. The plan should enhance the function of the commercial bank over the dissolution of the mono-banking system. Moreover, the nation should make an effort to prevent the financial crisis from misuse of the independent banking system.
