Abstract
The aim of this article is to show that two-level utilitarianism is not open to standard objections like scapegoat case that are commonly brought against traditional utilitarianism. Two-level utilitarian response to scapegoat case is two kinds. The core of the first reply is this. In the real world as we live, we have various alternatives to maximize utilities instead of making a scapegoat. Making a scapegoat can hardly be the best alternative since it cannot be preferred by the people for various reasons. The second reply can be summarized as follows. If we add several logically possible but highly unrealistic assumptions to the scapegoat case, we can admit that it is logically possible that making a scapegoat is morally justified from the two-level utilitarian point of view. It is not absurd to get a fantastic answer in a fantastic case. However, the approval to murder in this fantastic case is irrelevant to actual moral discourse, because it is nothing but a logical conclusion in response to intuitionists' unrealistic assumptions. In the real world as it is, one is highly unlikely to encounter this kind of case where we have sufficient time and sufficient information to have a full confidence on that making a scapegoat is the best alternative. Therefore, we can conclude that intuitionists' attacks based on counter-intuitive examples are not successful.
