Abstract
The judgment which it sentences from 2009 August 20th Supreme Court about what is the applicable law and principles for the cargo damage during multimodal transport is the leading case in Korean Supreme Court. As the result which analyzes the principle of liability of a combined transportation operator and a foreign judicial precedent, if there is not compulsory law, the contents of reverse side stipulation of the combined transportation BL is effective. To the case where the damage occurs meantime from the marine transport segment, an article 790 ① must be observed as compulsory law certainly in about marine transport responsibility. Also even if no evidences about the damage not being occurred during the maritime transportation, it also to be observed this articles of commercial code. I think The Supreme Court's judgment is very reasonable at these cases.
