Abstract
Constitutional powers on foreign affairs have been understood to be mainly exercised by President on the basis of the classical understanding of separation of powers. However, it is increasingly argued that the National Assembly should play more roles on the exercise as globalization attenuates boundaries between foreign affairs and domestic matters. Under the background, this article suggests a new constitutional approach to the powers through focusing on treaty issues on the basis of the dynamic understanding of separation of powers. It is required to be interpretatively rectified that President exclusively has treaty powers and the National Assembly subsequently controls the powers by consenting its conclusion. First, the legislative power shall be dominantly vested in the National Assembly(Article 40 of the Constitution). Other branches have the legislative power only either to prepare for emergencies(Article 76 of the Constitution) or to supplement the original legislative power within the boundary of delegation of the National Assembly(Article 75 and 95 of the Constitution). As a positive matter, treaties have the same force as legislation by generally affecting people’s daily life in terms of rights and duties, and as a normative matter, Article 6 of the Constitution declares that they shall have the same effect as domestic laws without further legislation in the National Assembly. Therefore, the National Assembly has the power to fundamentally form and meticulously review treaties that are effective as domestic laws. Second, the treaty-making process is the joint action both of the executive branch and the legislative branch, so both branches share treaty powers to be cooperatively exercised. Although Article 73 of the Constitution declares that President shall conclude and ratify treaties, the Article should be construed as focusing on expressing and implementing the intent abroad which President has formed and reviewed along with the National Assembly. Third, it would be possible to promote National Assembly’s role in the treaty-making process by strengthening and actualizing its consent power. However, the consent conceptually means the determination only on whether to agree with the conclusion as a whole or not, so it is interpretatively limited that the National Assembly could form and review treaties on the basis of the consent power. On the contrary, it is interpretatively reasonable that, on the one hand, President has treaty powers based on the executive perspectives, and on the other, the National Assembly has the powers based on the legislative aspects.
