대중국 무역구제 신 동향 및 중국의 보조금제도에 미치는 영향

Abstract

During the periods 1978 to 2003, China did not have Countervailing Measures levied against it by foreign counties because of its non-market economy. However, this situation has been changing as China joins in the World Trade Organization (WTO) and rises in position within the world market. United states of America, Canada and other countries do not acknowledge the market economy position of China and they are considering the plan to take Countervailing Measures. Canada invoked an anti-subsidy investigation in four cases concerning Chinese products and took Countervailing Measures about two cases since April 2004. China has been recognized the market economy nation position from already many in the method of the quantum negotiation nations. On the other hand, although the external environment has changed rapidly, domestic counter-measures within china are still defective. China used the subsidy for important means which have executed the economic policy of the nation. Many problems are still existing, even though they have been developing their subsidy relation legislation since 1990. In addition, China does not have to do an anti-subsidy investigation about the imports from foreign countries. The recent use of Countervailing Measures has created a very big impact in China. A subsidy and an anti-subsidy law revision will certainly need to be achieved in China. Korea gave the complete market economy position in APEC top meeting that taken place in Pusan some time ago at China. Korea has utilized the subsidy problem as one negotiation card and have trade relations with China. Therefore, we need thorough research about a relation subsidy policy and legislation in China.
