Abstract

In this paper, the scope of application of the CISG(The United Nations Convention on Contract for the International Sale of Good) in USA, China, and Korea has been reviewed in the context of comparative law basis. At first, the survey report on the CISG applications based on the questionaire to lawyers, working in the field of the international trade, was introduced. Inspite of the fact that there exist greate academic concerns and expectations toward CISG, broad applications of CISG in practice seems to require more time. Such phenomenon is common in the most major trading countries including US, Germany, China, and Korea. In case of US court decisions on the CISG application, there are numbers of incoherent cases against international trend. It is desirable for the American court which generates great deal of impacts to the world, to consider international court cases and international publications about the CISG for the reference. In China, there is some confusion between domestic law and CISG without proper legitimate considerations. Such conflicts in the application of CISG among the major trading countries will be diminished by the enlargement of CLOUT and the effort of many scholars. As the CISG has been effective from March 1, 2005 in Korea, no court case or arbitral award on the CISG application was officially reported to CLOUT(Case Law on UNCITRAL Texts) until now. But I think the Seoul East District Court Decision(2007.11.16, 2006 GA HAP 6384) may be the first and the only case on the CISG application in Korea, which has been briefly analysed in this paper. In my opinion, the Court should have considered the international cases in the judgment in order to achieve the international uniformity. I also feel sorry that the reason, why the judgment is not registered in CLOUT, is dereliction of our duty as the CISG member. Now, as long as the trading partners of Korean firms located in CISG member countries including China, USA, and even Japan, don’t exclude the applications of the CISG, it will be automatically applied to the most Korean foreign sales. As disputes regarding CISG will be noticeably increased, the encouragement of the interest toward CISG to staffs in charge of international trade will be necessary. That is the reason why academic-industrial cooperative research of CISG has to be carried out. And, the CISG will also be excellent reference data in the process of the civil law amendment in Korea as shown in the case of China and Japan. Therefore, the academic collaboration among the civil law, commercial law, and international trade law regarding these task agendas should be strongly prompt.
