Abstract
As of October 1, 2005, CISG has 65 States parties which have different legal traditions and economies. The amount of case law grows constantly. Currently about 1,000 cases are available from various sources. Case law has definitely contributed to the goal of the uniform interpretation and application of CISG. A review of decisions of courts and arbitral tribunals interpreting CISG would assist judges, arbitrators, lawyers, and parties to business transactions. It would also further the uniformity of interpretation and application of CISG. In reviewing decisions, common views of case law will be highlighted and divergent approach will also be presented. This would eventually facilitate the emergence of the uniform interpretation of CISG.
