Abstract

The writer overviews, in this essay, the concept of sovereignty and its transition, and goes on further to consider the impact on the legislative principles about application of the Criminal Act. This essay focuses on the topic of absolute personal principle and generally recognized rules of international law. Article 3 of the Criminal Act provides, under the heading of ‘Crimes by Koreans outside Korea’, “This Act shall apply to all Korean nationals who commit crimes outside the territory of the Republic of Korea”. Sovereign states have criminal jurisdictions over criminals committing crimes within their territories according to the territorial principle, regardless of their nationality, unless sovereign states' exercise of jurisdiction is confined by some treaties. In contrast, foreign countries cannot intervene in the criminal jurisdiction of the states of locus commissi, the exercises of which are only pure internal matters. Nevertheless, if the national states punishes criminals of their nationals for their offenses committed in the foreign countries exploiting the chances of their returns, such punishments presuppose that they are the potential subjects in absentia of their criminal laws. Those lead to inevitable clashes between personal principle of the national state of the criminal and territorial principle of the state locus commissi. Furthermore, the states' application of personal principle to the nationals abroad, whether their stays are long or short, restrict their nationals' conduct heavily. The nationals abroad, not only neither when the state locus commissi punishes the kind of act committed by the people but also nor when the constituting elements of certain crimes and their punishment thereof are same between the state locus commissi and the national state, the punishment of the national state requires constant prior learning about the laws of those states. This imposes boresome and unnecessary burdens on the nationals abroad. Article 3 of the Criminal Act is an act not complying the requirement of legislating in the state of ‘veil of ignorance’. This suggests unconstitutionality of the Article. The universal jurisdiction assumes that the crimes under that jurisdiction are the crimes under the international criminal law. And under the doctrine of universality, a nation, neither the national state nor the state locus commissi, intervenes and exercises the criminal jurisdiction by the name of ‘representative’ of the nations competent of the trial. There are two theoretical grounds about how generally recognized rules of international law have the same effect as the domestic laws. Those are ‘doctrine of incorporation’ and ‘doctrine of transformation’. However, competing theories can exist only in the unwritten constitutional countries or in the written constitutional countries without having provision of ‘automatic incorporation’. Under the Article 6(1) of the Constitution of the Republic of Korea, “…… the generally recognized rules of international law shall have the same effect as the domestic laws of the Republic of Korea”. That Article recognizes the ‘automatic incorporation’ about the generally recognized rules of international law. But this sort of ‘automatic incorporation’ heavily restricts the legislating sovereignty of Parliament. The real problem of the ‘automatic incorporation’ is that the automatically incorporated rules should contain the crimes of international customary criminal law due to the equivalence of the Artcle 6(1) and the Articles 12(1), 13(1) from which principle of legality derives. And that makes possible the courts of Korea, one of the written constitutional state, to punish the international customary crimes, even though it is impossible to punish the acts of reprehensible character under the name of contravention of customary criminal law. The writer agrees, as a reasonable ground of punishing the international customary crimes, with the Merkel J, minority opinion, in Nulyarimma v Thompson that international customary crimes are not the judge-made crimes but the incorporated crimes existing long time before. However, as the Act on Punishment, etc. of Crimes under jurisdiction of the international Criminal Court is enacted for implementing the Rome Statute of the International Criminal Court, most crimes excepting very few crimes such as piracy disappears from international customary criminal law.
