최면은 목격자, 희생자이든 용의자이든, 기억을 재생하거나 목격과 증언을 강화하기 위해 범죄 수사의 과정에 자주 사용되어 왔으며 잊었던 내용의 기억을 탐색하는 방법 중 최면이 기억을 강화하는 영역에서 더 많은 신뢰를 받았다는 것이 입증되었다. 따라서 지난 십년 간 최면은 목격자, 피해자, 용의자이든 기억을 재생하거나 목격과 증언을 강화하기 위해 범죄 수사의 과정에 자주 사용되어 왔다. 특히 성폭력사건에 대한 최면수사의 상황에서 잠재적 유용성은 목격한 것이나 혹은 범죄에 의해 야기된 긴장이나 고통을 경감하도록 도와주는 것이다. 능숙한 최면가는 피해자를 다른 마음의 틀로 이끌어 편안하게 하는 방법으로 사용할 수 있고, 일어난 일에서 또 다른 경험으로 관심을 옮기든지 아니면 경험의 불편한 차원에서 상대적으로 중립적인 차원으로 옮기도록 도움으로써 정신적인 충격을 경감시키도록 도울 수 있다.
Abstract
This article has been suggested that hypnotic techniques may have the potential to enhance eyewitness memory in forensic investigations. The maim alleged feature of hypnosis, which has led many to advocate its use in forensic contexts, is its ability to enhance memory. Hypnosis has also been advocated an truth-seeking device, a technique to evaluate a defendant’s sanity, an aid in the preparation of witness or parties for trial, a means of detecting malingering, an aid in obtaining admissions and confessions, and as a defense in criminal case. In case of sexual assault, the other potential use of hypnosis in forensic context is to help alleviate the stress and distress in having witnessed or been victimized by a crime. A skillful practitioner can help lessen the trauma by easing the person into a different frame of mind, either by helping the person shift from one uncomfortable dimension of experience to another that is relatively neutral.
