복사필적의 감정자료 적합성에 관한 연구

본 연구의 목적은 1 차 복사된 필적이 감정자료로서 적합한 지를 확인하는 것이다. 지금까지 한국의 국가감정기관에서는 복사된 필적은 감정에서 배제했다. 그러나 사설감정기관에서는 복사된 필적으로도 감정을 실시하여 왔다. 여기에서는 다양한 필기구로 작성된 원본필적과 복사필적의 차이를 살펴보았다. 그리고 복사필적을 감정자료로 사용할 수 있는지 확인하였다. 본 연구를 통하여 필적의 1 차 복사본은 감정자료로서 사용될 수 있다는 것을 확인하였다. 다만 청색이나 적색볼펜의 복사필적은 진하기에따라 원본필적과 상당한 차이를 보이는데 이러한 복사필적들은 감정자료로 적합하지 않다.
Abstract
This study aims at discussing the admissibility of balck-and-white copied handwriting as an evidence in handwriting identification (HI). In Korea the NISI and SPO excludes any copied handwriting in HI by this time. But most of the private document laboratories examine handwritings on the copied handwritngs. We compared the original handwriting with the copied handwritings. The copied handwritings were made as three types of copy densty, lighter 1 (CD-L1), auto (CD-A), darker 1 (CD-D1). The result shows that the first generation copy of a handwriting can be admitted as a proper evidence in HI, except the handwritings written by bule or red ball point pen.
