‘죄’ 와 ‘형벌’ 개념에 대한 반(反)정초주의적 비판에 대한 논의 - 니체(F. W. Neitzsche)의 『도덕의계보』를 중심으로

본 논문은 우리가 의심 없이 받아들이고 있는 선 ․ 악의 기준은 확실한 근거에 서있는지, 혹은 그것에 기초한 죄와 형벌이 과연 정당한 기초에 서있는지의 문제를 다룬다. 본 논문에서는 이 문제를 정초주의 철학과 그에 반대하는 반정초주의 철학의 논쟁과 직간접적으로 연결시킨다. 정초주의 대 반정초주의의 쟁점들은 이성 개념의 옹호와 그 개념에 대한 비판으로 압축 설명될 수 있다. 그러한 근거에 기초하여 죄와 형벌 개념 역시 이성을 보는 관점에 따라 매우 다르게 나타 날 수 있다는 점을 본 논문은 부각시킨다. 본 논문에서는 형사법적 정의에 기초한 죄와 형벌을 정초주의 철학의 기초로부터 유래한 것으로 보고, 그에 반해 니체의『도덕의 계보』에 나타난 죄와 형벌 개념을 반정초주의적 철학으로 대비시키는 과정을 통해 수행된다. 그 구체적 과정은 정초주의와 반정초주의적 입장에서 일반 형사법적 정의에 기초한 죄와 형벌의 의미와 니체가 주장하는 죄와 형벌의 의미를 비교 ․ 상론하는 것으로 진행된다. 근본적으로 본 논문 안에서 이러한 작업은 교정학과 철학을 접목시키는 데에 그 목표가 설정된다.
Abstract
The purpose of this paper is to discuss the two issues, if the existing criterion of Good and Evil has been on a firm ground, and if the concept of guilt and punishment based on the existing criterion has been established on a reasonable and legitimate basis. The discussion will be started by reviewing the philosophical disputes between foundationalism and antifoundationalism. The disputes between foundationalsim and antifoundationalism can be summarized into the defense and critique on the concept of reason. This paper highlights that the concepts of guilt and punishment very different according to the viewpoints on reason. In the second part, the paper shows contrasts between the concepts of guilt and punishment of foundationalism and antifoundationalism. The paper presumes that the concept based on the definition of criminal law is originated from foundationalism, and that from Nietzsche's The Genealogy of Morals is originated from antifoundationalism. It discusses and compares differences in the meanings of guilt and punishment between the definition of criminal law and that of Nietzsche, from the viewpoint of foundationalism vs. antifoundationalism. In the last part, the paper attempts to integrate corrections studies with philosophical discourse.
