범죄기회와 위험요인이 소년 교도소 수형자의 범죄에 미치는 영향:범죄 유형별 분석

초록

청소년 범죄의 근원적인 문제를 진단하여 장기적인 관점의 범죄예방 정책을 구축하고자 본 연구는 김천 소년 교도소 수형자의 범죄유형별 범죄기회와 위험요인을 분석하였다. 위험요인 진단을 통한 범죄예방에서 제시하는 요인들은 그 이론적 토대를 사회통제이론과 일상활동이론, 생활양식에서 찾을 수 있다. 따라서 세 가지 이론에서 제시하는 범죄촉발 요인으로서 가정과 학교의 통제 (자유시간, 가출, 학업중단), 위험적 요인 (늦은밤 함께한 장소와 사람, 위험적 생활양식, 자주가는 장소의 특징), 일탈행동 (음주, 흡연, 약물)이 조사되었다. 조사결과 소년 수형자들은 부모의 관리/감독에서 벗어나 많은 자유시간을 가지고 있었으며, 위험적 생활양식도 강하며, 늦은 밤 우범지역에서 친구들과 함께하는 시간과 빈도가 많았다. 소년 수형자 중 50% 이상이 이미 범행당시 학업을 중단한 상태였으며 가출의 경험과 횟수도 상당히 빠르고 많았다. 음주, 흡연, 약물에 처음 접한 나이, 경험, 횟수면에서도 심각한 상황을 보여주었다. 각 위험요인 별로 범죄 유형별 차이는 크진 않았지만 절도와 강도사범의 가출, 학업중단, 전과기록이 두드러졌다. 본 연구결과를 토대로 청소년의 범죄기회와 위기적 상황을 감소시키기 위한 전략으로 한부모, 조손가정에 대한 지원강화와 상담/멘토링 강화, 저소득층 위기 청소년에 대한 학업지원과 학교활동 지원의 강화, 경찰과 지역사회의 협력을 통한 우범지역에서의 청소년 보호 강화, 위기 청소년과 소년 수형자에 대한 심리상담 실시, 절도사범에 대한 통합적 범죄예방책 구축 등이 정책제언으로 제시되었다

Abstract

To investigate high risk situations and crime opportunities of juvenile offenders at the Gimcheon Boy Correctional Institution, 144 juvenile inmates at the Gimcheon Boy Correctional Institution participated in the survey. Based on social control theory, routine activity theory and lifestyle theory, free time, runaway, school dropout, persons and places at late night, risky life style, features of places, drug, alcohol and smoking are investigated as risk factors affecting juvenile delinquency. The research results demonstrate that juvenile inmates are more likely to hang around at the crime-prone areas at late night than youth in comparison group. Regarding the deviant behaviors such as alcohol, smoking, substance abuse and running away, juvenile inmates show more serious situations than youth in comparison group. Based on the research results, enhancing welfare supports for single parent/ grandparent family, strengthening educational supports for at-risk youths, implementing strict off-limits to youth in crime-prone areas under the cooperation of police and community members, and establishing psychological counseling for at risk youth and juvenile inmates in Gimcheon Boy Correctional Institution are presented as policy implications.
