전통적인 전문경찰활동에서 범죄문제는 고유한 경찰영역이었고, 지 역사회는 단지 경찰 서비스의 고객으로서 수동적인 역할에 머물렀다. 그러나 오늘날 범죄문제는 지역사회 내의 현상으로 보고, 경찰이 더 이상 전권을 가질 수 없다는 인식하에 지역사회경찰활동이 확산되고 있다. 경찰활동에 경찰과 지역사회와의 협력, 공동책임, 문제해결, 참 여 등이 강조된다. 그러나 경찰은 형사사법시스템의 틀 내에서 움직이 는 한계로 인해 여전히 전통적 경찰활동 방식이 선호되기도 한다. 최근 처벌에 초점이 맞추어지는 전통적 형사사법시스템의 한계를 극복하기 위해 회복적 사법이 새로운 패러다임으로 제시되고 있다. 회 복적 사법은 범죄가 어떻게 해결되고 예방될 수 있는지에 관해서도 폭넓은 이해를 갖고 접근하고 있다. 범죄를 법적인 차원에서만 정의하 지 않고, 인간, 인간-인간 간의 관계에 대한 침해로 보며, 피해자나 지 역사회 등이 입은 폐해의 회복에 초점을 두고 있다. 가해자에 대해서 도 격리와 추방보다는 지역사회와의 협력, 지역사회로의 재통합을 강 조한다. 그 결과 사람들 간의 관계와 지역사회를 강화시킴으로써 범죄 와 무질서에 대해 자연스럽게 저항할 수 있을 것으로 본다. 회복적 사법이나 지역사회경찰활동 모두 범죄문제에 대해 시민참여 와 개입, 협력관계, 문제해결, 공동책임 등 지역사회 대응의 중요성을 강조하고 있어 이 양자를 접목시킨 경찰활동에 대한 연구 필요성이 제기된다. 본 논문은 이런 배경을 갖고 지역사회경찰활동 다음 단계로 민주주 의 사회에서 경찰이 나아가야 할 방향으로 회복적 경찰활동을 제시하 였다. 회복적 경찰활동에서는 범죄문제에 대해 진압적인 해결을 벗어 나 범죄피해자 등을 돌보고, 피해자와 가해자 측을 화해시키고, 지역 사회를 촉진하는 비공식적 접근이 강조된다. 경찰은 지역사회와 상당 히 밀접하게 연결되어 있기 때문에 회복적 사법의 가치와 원리를 적 용하는데 있어 중요한 역할을 할 수 있을 것으로 보인다. 회복적 경찰활동을 효과적으로 실행하기 위한 과제로는 첫째, 회복 적 경찰활동에 대한 입법과 정책의 뒷받침이 필요하며, 둘째, 경찰조 직구조와 문화의 변화가 필요하고, 셋째, 회복적 사법의 가치와 원리 에 저항하는 경찰관을 최소화시켜야 하며, 넷째, 지역사회의 참여와 역량을 강화할 필요가 있다.
Abstract
Recently, restorative justice is presented as new paradigm so that focus overcomes traditional criminal justice's limit that is set to the punishment. Restorative justice is approaching with wide comprehension how crime can be solved and prevent. It involves the resolution of conflict through community building after crime and disorder problems have been identified. The focus is on identifying harm and on repairing the harm as far as possible based on a shared understanding of who has been harmed and how. As a result, see to resist naturally about crime and disorder by strengthening relation and local community between people This study examined the link of restorative justice and community policing, which is restorative policing. Restorative policing appears to represent the next logical step in community policing. It is far removed from the mainstream paradigm of retribution and focus on offenders. It also requires far more than thinking with traditional formal responses. It is being transformed to communities, including both its victims and offenders, process for strengthening caring relationships and developing the sense of connectedness. To effective implementation of restorative policing, first, it is required by legislation support of restorative policing for example Canadian Youth Justice Act. Second, structure and culture of police organizations require attention in restorative policing. Third, it needs to minimize police officer resisting to the value and principle of restorative justice. Finally, it needs to strengthen capacity and participation of community.
