경찰의 질서와 인권간의 균형의식의 확립에 대한 연구에 관한 연구

개인의 인권과 자유는 공동체질서 내에서 생존한다. 공동체를 떠난 개인의 자유는 없는 것이다. 인권보호를 지나치게 강조하면 법질서 유지 곤란도가 증가하는 반면, 법질서유지 공권을 강조하면 인권침해 증가가 불가피해 진다. 인권은 인간본성의 존재양식이며, 질서는 자유의 보장장치가 된다. 인권은 주어진 질서이나 인권보호는 만드는 질서에 속한다. 인권과 질서의 가치는 수레바퀴의 축과 같이 국가운영과 사회통합 역할의 지주가 된다. 그런데 인권보호와 질서유지간에 가치충돌의 문제가 발생할 수 있으며, 이들 사이에서 어떻게 하면 조화. 균형을 이루어 사람중심의 질서를 만들어서 이 사회를 통합해 나갈 것인가가 관건이다. 인권이 이상적. 규범적 가치를 지향하는 특성을 지닌 반면, 질서는 현실적, 생활적 기술력을 토대로 하는 사회제약. 지원. 보호장치의 의미를 지닌다. 주어진 질서로서의 인권을 본래의 형상대로 잘 보호하기 위해서는 만드는 질서라고 할 수 있는 인위적 질서와 평화가 균형점을 찾아 제도. 법. 정책. 서비스 등에 의해서 만들어져 나가야 한다. 그러므로 경찰관은 마음으로 시민을 보듬어야 한다. 인권존중, 큰 봉사와 사상을 기본 신조로 시민이 원하는 것이 무엇인가를 찾아 나서야 한다. 시민의 어려움과 사회적 약자의 아픔을 볼 수 있는 눈을 가지는 일에 감동을 보여 주어야 한다. 경찰의 본질적 사회기능과 역할의 뿌리는 사회통합이다.
Abstract
The fundamental rights of man is dignified. It is self-governing spirit to determine spontaneously what to do. In particular, we think that the freedom from other's suppression, fear, poverty and ignorance is a supreme value to all of us. An individual human rights and liberty is existed within the order of community. The growth of economic and competetion of knowledge is possible with the support of the secure structure of order and stable environment. And the social, lawful, political and economic order is not achieved in a short time. Human rights is a given order, but the protection of it is a preparing order. The order of equipment for the protection of human rights is to be organized. The bolt of the protection of human rights depends upon preparing the order in a certain way. The value of human rights and order becomes a support of national management and social integration like an axis of wheel. What is the origin of order and the constructive principle of it. This is like the reason that we must know the direction in case of going to the way, and a water course in time of going fishing. This study is to treat the issue between the protection of human rights and order maintenance and to research how the harmony between human rights and order is achieved. Besides it, this study is how the man-centered order can be established. And this researcher will form the direction of police policy on the basis of it, ultimately make a plan to achieve the social integration. This study′s logic is that social integration affects the reinforcement in inner solidarity and the prevention from threat of the surrounding nations. Under the support of it, human rights and order is protected. Police has been involved in arresting, investigating an injurer and proceeding against him criminally. We recognized that it was security service and essence of police activity. But the character of security service is converted into protecting, caring the criminal victims as well as an injurer from now. This fact is man-centered police policy, the paradigm of police duty, moreover the fragrant integration of human rights and order.
