아동성범죄자의 재범억제방안에 관한 연구

초록

아동을 대상으로 하는 성범죄는 인류의 가장 치욕스러운 범죄행위 중 일부라고 할 수 있지만 매년 증가하고 있으며, 그 행태 역시 매우 다양한 방법으로 이루어지고 있다. 이 연구의 목적은 아동을 대상으로 하는 성범죄자들의 동종재범을 억제하는 방안을 강구하는 데에 있으며, 아동대상 성범죄자를 아동성도착증 혹은 소아기호증이 있는 그룹에 대한 대책과 아동성폭력범에 대한 대책을 함께 제시하였다. 이는 최근 아동대상 성범죄자의 신상공개 대상자의 통계 및 언론에 보도되는 아동대상 성범죄가 상당부분 소아기호증적 증세를 보이는 경우가 상당하기 때문이다. 아동대상 성범죄의 원인을 설명하는 모노아민가설이론, 정신분석이론, 구애장애이론, 학습이론, 애착이론 등 다양하다. 가장 공통적인 설명은 아동기에 부모와의 유대가 약하고, 성적 학대경험이 있는 경우에 성정과정에 영향을 주며, 자아존중감 및 자신감 등이 결여되며, 결국 성적 일탈을 야기한다는 것이다. 이와는 달리 단순 아동성폭력사범의 경우에는 성적 대상을 공격하기 쉬운 아동을 그 피해자로 정하는 것으로 다른 강력범죄 못지않게 반복성을 보인다. 이는 범인의 사회경제적인 특성과 함께 청소년성보호법을 비롯한 법률적용의 문제, 교정처우의 한계 등이 주요원인일 것으로 보인다. 특히 전문적인 교정처우는 상당한 문제점으로 지적된다. 이와 같은 인식을 전제로 아동대상 성범죄의 재범을 억제하기 위한 방안을 다음과 같이 제안할 수 있다. 첫째, 아동대상 성범죄자의 신상공개와 그 딜레마에 대한 대안으로 신상정보열람제도의 개선, 둘째, 강력한 입법과 재범률 증가의 모순에 대한 대안으로 아동대상 성범죄관련 처벌법의 엄격한 적용, 셋째, 정신장애 아동대상 성범죄자의 교정처우한계에 대한 대안으로 정신장애 아동대상 성범죄자에 대한 치료감호 및 교정처우 강화, 넷째, 범죄피해예방정책과 그 실효성 쟁점에 대한 대안으로 실질적인 범죄피해예방정책의 모색 등의 정책을 제시하였다.

Abstract

Child sex crime is mankind's most shameful criminal act, but it increase annually, and that behavior also made quite a variety of ways. This research subject is primarily of countermeasure against child sex offenders and pedophilia. Unfortunately, every year child sex criminal are vertically increase. I think, Primarily, the treatment and special treatment are need to pedophilia. Pedophilia or paedophilia has a range of definitions as found in common usage, psychology. According to the DSM, pedophilia is match the following conditions of diagnostic criteria for pedophilia A. Over a period of at least 6 months, recurrent, intense sexually arousing fantasies, sexual urges, or behaviors involving sexual activity with a prepubescent child or children (generally age 13 years or younger); B. The person has acted on these sexual urges, or the sexual urges or fantasies cause marked distress or interpersonal difficulty; C. The person is at least age 16 years and at least 5 years older than the child or children in Criterion A. There are many of theories about motives of pedophilia and child sex abuse or child molester. For example, monoamine hypothesis, psychoanalytic theory, courtship theory, learning theory, attachment theory and so on. Recently, there are many of countermeasures about child sex offenders. But there are little effect. Then, I purpose many countermeasures which are more than now policies. First, personal information disclosure system of child sex offenders is need to be improvement. Second, the laws of child sex crime are should be strictly applied. Third, mental health commitment and strengthening treatment policy is introduced to mental illness child sex criminal. Fourth, substantial child sex crime prevention policy is should be strengthened.
