동북아지역 국제 경찰공조의 발전방안에 관한 연구 - 초국가적 범죄 대응방식을 중심으로 -

Abstract

In the northeast Asian Region, world's main international criminal syndicates such as Chinese Triad, Japanese Yakuja and Russian Mafia directly threaten the regional security while constantly providing a possibility of linking with Korean criminal syndicates, and the cooperative system between nations in Northeastern Asia against such a transnational crime has been continuously developed on the basis of the traditional mutual-assistance system of international criminal laws. However, the traditional mutual-assistance system of international criminal laws is difficult in coping rapidly with transnational crimes due to its complex procedures and long-term disturbance while lacking the function of prevention. Therefore, this study aims to consider desirable plans of international police mutual-assistance in the Northeast Asian Region. With the investigation into the results of this study, it was found that the most ideal plan of coping with transnational crimes in the Northeast Asian Region may be to establish a permanent and independent police cooperative organization like Europol or Schengen through treaties. Prior to this plan, it is required to expand the mutual-assistance range of the existing mutual-assistance system of international criminal laws and simplify its procedures while institutional complements should be made to actively utilize Interpol channels. Therefore, it is needed to reinforce the legal status of Interpol in the international laws by converting the non-intergovernmental organization into an intergovernmental one. It is also required to establish both internationally and nationally legal bases for Interpol activities by revising the national laws so that the validity of the Interpol Red Notice may be approved as equally as warrants of arrest.
