현대사회에서 범죄의 다양화, 전문화, 인력과 예산의 부족 등으로 정부 기능의 한계를 드러날 수밖에 없고 반면에 경제적 수준의 향상과 개인의 삶의 질 향상에 따른 안전 및 개인의 권리 보호에 대한 수요는 증가 할 수밖에 없다. 의뢰인에 대한 사실조사 서비스 제공과 같은 민간조사 제도는 외국에서는 오래 전부터 이용되어 왔으나 한국은 이와 같은 제도가 그동안 있지 않았기 때문에 흥신소나 심부름센터 같은 서비스업에서 수행되어 옴으로써 비전문성, 윤리성, 제도의 미비 등으로 인해 국민들에게 많은 불편을 끼칠 수밖에 없었다. 예로써, 실종자 · 미아 · 가출인과 같은 오랜 시간이 소요되는 사건은 해결하기까지 많은 시간이 소요되고 한정된 수사 인력으로는 시민들에게 만족할 만한 치안서비스를 제공해 주는데 한계가 있다 보니 장기간 미제로 남아 있는 경우가 많고 사생활의 비밀의 노출이 우려되는 사건은 당사자가 신고를 꺼려 수사가 제때에 이루어지지 않는 경우가 있으며 경찰이 사건을 제대로 해결해 주지 못함으로서 피해자들의 불만의 목소리가 높았다. 사회의 복잡성 · 다양성으로 인해 개인의 권리 구제 및 피해 회복을 위한 사실관계 조사의 필요성을 물론이고 이에 대한 사실조사 서비스의 수요 역시 증가 될 수밖에 없다. 민간조사제도 도입의 필요성으로 불법적으로 운영되는 심부름센터 등으로 인한 침해가 크다는 점, 경찰 업무가 많고 전담인력이 적다는 점, 신규 일자리 창출에 기여 한다는 점, 공경비의 역할한계에 대한 보완, 외국 민간조사 업체의 국내 진출 및 시장 잠식 등을 들 수 있다. 본 연구는 경비업법 일부 개정안을 기반으로 민간조사제도 도입의 필요성과 그 핵심내용을 분석하여 함의를 도출하는데 연구의 목적을 두고 있다.
Abstract
The private investigation system such as investigation services has been used for long time in the overseas. However, because of lack of governmental system in the South Korea, those services are provided by private detective agency and resulted negative images to the public due to unprofessionalism, lack of ethics and inadequate governmental system. There are more threatening elements to the public in the internationalized and informationized twenty first century. In these circumstances, investigative agency such as Police does not meet public satisfaction of public security requirement as the limitation of workforce, budget and office work. Therefore, because of the limitation of Police force, Police does not provide sufficient services its own to the public, the private investigation services are arisen as alternative. There were several trials of introduction of private investigation system in the past 10 years. However, it is true that there is a higher interest of the necessity of introducing of private investigation system at the political community in the recent years. The necessity of fact-finding services to recover personal right and to recover personal damage due to social complexity and diversity and increase of the amount of its related services will not be change. The reasons for the necessity of introduction of private investigation system are high infringement by the illegally operated private investigation agency, high amount of service load police force and its limitation, contribution of new job opportunities, supplement for the limitation of public police services and inroads into domestic private security services by foreign private investigation company. This study purpose to explain the necessity for an introduction of private investigation system based on revision of private security industry act and to conclude its implication by analysis of private security industry act.
