KCPI를 통한 방화범들의 재범위험성 예측

본 연구는 한국사회에서 발생하는 방화범들의 상습성에 심리적 요인들이 얼마나 영향을 미치는지 알아보기 위하여 통계분석을 하였다. 그 결과 방화범들은 사회․경제적으로 하류계층에 속하는 자들이 많으며, 동종방향 재범률은 약 35.5%였고, 범죄동기는 우발․격정 등과 같은 심리적 요인에 의한 방화가 63.3%로 높게 집계되었으며, 동기유형을 보면, 예모형, 복수형, 질투망상형이 많았고, 가해자와 피해자의 관계를 보면, 안면이 있는 타인이거나 가족이 피해자인 경우가 69.3%라는 점에서 방화를 무동기범죄의 대표적 유형으로 볼 수 없다는 점을 알 수 있었다. 심리적 특성을 보면, KCPI의 하위척도중 ‘망상성’과 ‘범죄성’이 방화재범횟수를 가장 잘 예측해주는 변수임을 알 수 있는데, 이는 망상적 사고와 반사회적 사고를 하는 자들이 상습적 방화를 할 가능성이 높다는 것을 의미한다. 이러한 연구결과에 비추어 몇가지 논의를 하자면, 첫째 방화의 동기를 무동기로 보는 일반적 시각이 잘못 되었음을 알 수 있다. 그러함에도 불구하고 방화는 무동기에 의한 경우가 많다고 잘못 인식하는 것은 범죄분석 등과 같은 공식통계에서 방화동기의 분류에 오류가 있기 때문이라고 보여진다. 이는 범죄현상을 파악하는데 주로 사용되는 공식 범죄통계표에 대한 재검증작업이 필수적으로 이루어져야 함을 의미한다. 둘째, 방화범죄는 동종방향으로 재범을 범하는 비율이 본 연구에서는 35%이상으로 집계되었는데, 이는 방화범죄 수사에 있어서 참고할 만하다. 또한 현주건조물방화는 주로 아는 사람들을 피해자로 한다는 점에서(박형민, 2004:103) 1차적인 수사대상의 범위는 주변인중심 수사가 진행되는 것이 바람직하다고 본다. 셋째, 방화범죄를 포함하여 다양한 범죄유형별로 범죄인들의 심리적 특성에는 여러 가지 차이가 난다는 점을 알 수 있다. 특히 상습적 방화범의 경우에는 망상성과 범죄성이라고 하는 심리적 요인이 주요한 요소임을 알 수 있었다. 따라서 방화범죄에 대한 심리적 치료전략에서는 망상성과 범죄성에 초점을 둔 구조화된 프로그램의 접근이 필요할 것이다. 마지막으로 본 연구는 심리적 요인을 통하여 방화범들의 재범위험성을 예측하기 위하여 수행되었으나, 사례수가 적고, 실질적 면담조사가 아닌 가해자의 기록조사에 의존하고 있으며, 다른 방화유형(공용건물방화, 일반방화, 실화 등)과 비교하지 못했다는 점에서 한계가 있다. 그러함에도 객관적인 심리평가도구를 이용하여 방화범의 심리를 연구한 자료가 거의 없는 상태에서 본다면, 본 연구결과는 향후 방화범 연구에 있어서 기초자료로서의 가치는 충분하다고 본다.
Abstract
This study aimed to investigative demographic and psychological characteristics of Korean arsonists and examined the relationship between psychological factors and recidivism of arsonists. As a psychological assessment tool, KCPI was used in this study. KCPI information was collected from 166 arsonists who had been in prison. In order to investigate predictable variables of recidivism, correlation and multiple regression analysis were conducted. As a results, delinquency, aggressivity, criminality, abandonment disposition, suicide disposition, delusiveness had a high relationship with recidivism of arsonists. These variables provided 38% of explanations in number of re-offending. Particularly delusivenss and criminality were significant variables to predict the recidivism. Therefore offenders who have high score in delusivenss and criminality are likelihood of setting further fires.
