선장의 지위가 선주에서 공동 선주이자 선박 관리인, 그리고 선주의 피고용인으로 지위가 하락해 왔다는 것은 주지의 사실이다. 문제는 어느 시점에서 선장이 선주의 피고용인의 지위로 전락했는가 하는 점이다. 이 논문에서는 선장이 막강한 권한을 지닌 공동 선주 내지는 선박관리인에서 선주의 단순 피고용인이 되어가는 과정을 추적해 보았다. 이를 논증하기 위해 두 가지 차원, 즉 당대의 법전과 안내서 등에 명시된 선장의 권한과 의무를 살펴보고, 실제 선박에 승무했던 선장들의 사례를 분석하였다. 분석 결과, 18세기 초까지 선장은 공동 선주이자 화물 감독, 선박 관리인, 선박 운항자로서 용선계약의 체결에서부터 화물의 매입과 매각, 선박 관리, 선박 운항을 자신의 재량권 하에서 행하는 실로 막강한 지위에 있었다. 그러나 18세기 말에 이르면 선장은 해상(海商) 활동에서 손을 떼고 선박의 운항과 선박의 유지․관리에만 집중하는 선주의 피고용인인 임금노동자로 그 지위가 변화되었음을 확인하였다.
Abstract
It is well-known that master mariner's position has been declined from co-shipowner, ship's husband, or supercargo to the waged ship operator. In this paper the author tried to find out the period when master mariner was to be the waged ship operator. The author analyzed the French Maritime Ordinance(1681), Napoleon Code(1807), and Joseph Blunt's Shipmaster's Assistant and Commercial Digest(1837) in legal aspects and Uring's, Kelly's and Richardon's Journals in case study. In results, master mariner was so powerful as to make contracts for ship's operation, purchase and sell cargoes, and even to sell the ship itself as co-shipowner, ship's husband, or supercargo in the early of the 18th century. But around 1780's master mariner was the waged ship operator that just could maneuver the ship.
