영국해상보험법상 소말리아해적사건처리의 취급에 관한 연구

21세기 초 소말리아내전 이후로 소말리아해안에서의 해적행위는 국제해운에 위협이 되고 있다. 최근에 소말리아해안에서 해적에 의한 납치사건이 심각할 정도로 증가하고 있는 것이 현실이다. 소말리아해적들은 선박이나 화물을 약탈하기보다 그들은 선원을 인질로 하여 선주에게 석방금을 요구하고 있어, 2005년 이후로 국제해사기구(IMO)는 해적행위를 중대한 관심사로 취급하고 있다. Bunga Melati Dua호 사건에서 원고의 주의적 주장은 소말리아영해로 연행된 것은 화물이 1906년 영국해상보험법(MIA) 제57조 제(1)항에 규정한 회복할 수 없는 화물의 점유상실에 해당하므로 현실전손이 성립되며, 또한 대체적 주장에서는 본선과 화물은 현실전손이 불가피하므로 포기되고 있어 MIA 제60조 제(1)항에 규정한 추정전손이 성립한다고 주장했다. 이에 대해 법원은 원고의 주장을 전면적으로 배척했다.
Abstract
Piracy off the Somali coast has been a threat to international shipping since the Somali Civil War in the early 21st century. In recent years there has been significant growth in the number of piracy kidnap attacks off the Somali Coast. Rather than taking ships and their cargoes, Somalian pirates are taking crew members hostage and demanding ransom from vessel owners. Since 2005, International Maritime Organization has expressed concern over the rise in acts of piracy. In the Bunga Melati Dua, it is the claimant’s primary case that on the capture of the vessel by the pirates and its removal into Somali waters the cargo became an actual total loss in terms of s. 57(1) of the MIA in that the assured had been irretrievably deprived of the cargo. In the alternative the claimant asserted that there had been a constructive total loss under s. 60(1) of the MIA in that the vessel and cargo had been reasonably abandoned on account of its actual total loss appearing to be unavoidable. The court was concluded that the claimant has not made out its claim for a total loss whether actual or constructive. This renders it unnecessary to consider an alternative issue raised by the defendants as regards late declaration of freight under the policy.
