Abstract
This study examined principal actors of liability, vicarious liability of the carrier, the scope of application and the effects of statutory himalaya clause under the Rotterdam Rules. These issues are based on the concept of “performing parties" and “maritime performing parties". Performing party means a person other than the carrier that performs or undertakes to perform any of the carrier's obligations under a contract of carriage. A maritime performing party among the performing parties is subject to the obligations and liabilities imposed on the carrier under the Rotterdam Rules. The statutory himalaya clause under the Rotterdam Rules sets specifically the category of the parties who can invoke the statutory himalaya clause where the claim is founded on tort or otherwise. Furthermore it clarify the terms which may cause misrepresentation. From this point of view the statutory himalaya clause under the Rotterdam Rules has its significance in that it has reduced legal uncertainty related to the scope of application and the effects.
