Abstract

This study was initiated to discuss the necessity of imposing effective special conditions on probation for digital sex offenders. The main purpose of this study was to consider the guidance and supervision plan for compliance with probation in Korea by introducing conditions containing computer and Internet restriction imposed on digital sex offenders in the United States and the United Kingdom. In the case of the United States, as an extension of 「sex offender registration and notification Act」 in many states as well as federal laws, the grounds for ordering Internet and computer restrictions by courts as probation conditions for digital sex offenders have been prepared, and were actually being enforced at the probation process. These digital bans were not only applied to digital sex offenders, but restrictions were also ordered when using the Internet or computers for related criminal acts. In the case of the UK, the SHPO Act also restricted Internet access and computer use by digital sex offenders. In Korea, general conditions and special conditions are granted based on the 「Act on Probation」, but the reality is that only the same conditions as other crimes that do not consider the criminal characteristics and actor characteristics of digital sex offenders at all. Referring to the disposition of restrictions on the use of digital devices for sex offenders in the United States and the United Kingdom, it is necessary to discuss the preparation of specialized special compliance matters and the creation of an enforcement environment that can change the criminality and criminal environment of digital sex offenders.
