출퇴근재해는 업무상재해의 일종으로 업무상 인정기준을 종전과 달리 인식할 필요가 있다. 또한 출퇴근재해는 교통사고라는 속성을 고려할 때, 산재보험과 자동차보험간의 지급사유가 경합될 수 있다. 이 경우 근로자와 그 유족이 보험금을 선택하는 기준은 무엇이고, 보상기준, 산정방법, 면책여부 등에 따라 보상금액이 달라지는 원인을 알아본다. 근로복지공단은 보험회사등을 상대로 구상금을 청구할 경우, 과실상계, 노동능력상실률, 보상한도, 지급항목, 면책약관의 적용여부가 중요한 쟁점사항이라고 할 것이다. 구상업무의 효율적인 해결수단인 구상금협의조정기구를 필요성에 대하여도 검토한다.
Abstract
The commute and disaster in Korea is a kind of work - related disaster, and it is necessary to interpret the standard of work recognition different from the previous one. Also, considering the nature of traffic accidents, commuting accidents can be contended for reasons of compensation between the accident insurance and the automobile insurance. In this case, what is the criteria for the workers and their survivors to select the insurance benefit, and how the compensation amount varies depending on the compensation standard, the calculation method, and the indemnification. When the Welfare Corporation makes claims against insurance companies, it is an important point to consider whether the application of the negligence offset, the loss rate of the labor capacity, the compensation limit, the payment item and the indemnity clause. It also examines the necessity of an arbitration consultation coordination mechanism, which is an effective means of solving the concept work.
