몽골투자법상 외국인투자 제도에 관한 주요 내용과 시사점 - 외국인 투자 보호와 투자 촉진, 지원 제도를 중심으로 -

몽골은 세계 10대 광물자원 부국으로 오랜 기간 광산업 분야 개발을 통해 지속적으로 경제성장을 이루어 왔다. 이러한 높은 경제 성장과 빠른 발전상을 보여주어 외국인투자자들에게 몽골투자에 대한 관심을 높였으며, 몽골 내에서도 외국인투자를 높이기 위한 투자 환경 개선을 위한 노력이 계속 이루어지고 있다. 그러나 몽골은 여전히 세계의 다른 주요 국가들에 비해 상대적으로 경제발전 정도가 낮은 개발도상국이다. 몽골의 경제력을 높이고 강화하는 주요 방법 중 하나는 외국인 투자를 촉진하고 유치하는 것이다. 즉 높은 경제 성장, 다양한 부문에서의 제조 및 용역 개발, 빈곤 감소 등 경제 발전을 가장 빠르고 효과적으로 보장하는 방법으로 외국인 투자 기업을 몽골에 유치하고 지원하는 것이다. 외국인 투자를 촉진하기 위해서는 투자 친화적인 환경을 조성하는 것이 중요한데, 이를 위해 투자 관련 정책 및 법제가 몽골의 경제발전에 기여할 수 있도록 만들어져야 한다. 이에 본 논문은 먼저 몽골의 투자정책을 개괄적으로 살펴보고, 이어서 2013년 제정된 투자법을 중심으로 투자친화적인 환경을 조성하는 데 있어서 중요한 법적 제도인 투자보호제도와 외국인투자 촉진 및 지원제도를 살펴본다. 끝으로 이러한 논의를 토대로 향후 바람직한 투자환경 조성을 위한 시사점을 도출하고자 한다.
Abstract
Mongolia has continued the economic growth through long time mine industry development as one of World's Top 10 Mineral Resources Rich Countries. By showing such high economic growth and rapid development, foreign investors have increased their interest in Mongolian investment, and efforts are continuing to improve the investment environment to increase foreign investment in Mongolia. However, Mongolia is a still developing country of which economic growth level is relatively lower than other global countries. One of method to elevate and strengthen the economic power of Mongolia is to promote and attract the foreigner's investment. That is, attracting and supporting foreign investment companies to Mongolia in the fastest and most effective way to ensure economic development, such as high economic growth, manufacturing and service development in various sectors, and poverty reduction. It is important to form the investment friendly environment in order to promote the foreigner's investment, to the end, the investment related policy and legislation should be designed to contribute to the economic development of Mongolia. Therefore, first this paper outlines Mongolia's investment policy. Next, we examine the investment protection system and the foreign investment promotion and support system, which are important legal systems in creating an investment-friendly environment centering on the 『Investment Law』 enacted in 2013. Finally, based on these discussions, this paper attempts to derive implications for creating a desirable investment environment in the future.
