Abstract

As a type of alternative dispute resolution system, which is a non-litigation dispute resolution method, there is a resident autonomy mediation system. This mediation system is to easily resolve disputes between residents, such as neighborhood disputes in the local community, as residents, not external experts, directly become mediators. Recently, the resident autonomy mediation system has begun to be introduced in Korea. The resident autonomy mediation system is an institutional device that allows dispute parties to resolve disputes autonomously based on mutual concessions and compromises with the help of resident mediator. Compared to litigation, the resident autonomy mediation system restores the relationship between residents by solving problems that meet the level of demand of the parties to the dispute, thereby contributing to the creation of a harmonious community. Therefore, in major foreign countries, especially China and Taiwan, the resident autonomy mediation system is regulated by national law, and the resident autonomy mediation system has already been established and activated as a valid dispute resolution system. Considering the significance and function of the resident autonomy mediation system, it is necessary to derive its implications through research on the resident autonomy mediation system in China and Taiwan.
