기후변화에 관한 정부 간 협의체(IPCC)가 2023년 발표한 보고서는 지구 온도 2°C 상승을 제한하기 위하여 신속하고, 지속 가능하며 대규모적인 행동의 필요성에 대해 경고하였다. 기후위기에 직면한 세계 각국은 탄소중립을 실현하기 위하여 탈원전 정책에서 원자력 에너지의 비중을 확대하는 방향으로 에너지 정책을 수정하고 있다. 프랑스도 기후위기에 대처하고 에너지 독립을 실현하기 위하여 「기존 원자력발전소 인근 신규 원자력시설 건축 가속화 및 기존 시설 운영에 관한 2023년 6월 22일 법률 제2023-491호」를 제정하였다. 동 법률은 에너지 믹스에서 원자력 에너지의 비중을 확대하고, 새로운 원자력 발전소 건축에 관한 행정절차를 간소화하였다. 또한 동 법은 신규 원자력발전소 건설을 가속화는 조치뿐만 아니라 기존 원자력기본시설(INB)의 관리를 통해 안정성 통제를 강화하면서 가동 기한을 연장하는 조치를 도입하였다. 현실적으로 탈원전 정책을 견지하기 어렵고 그 이유가 기후위기에 대처하기 위한 것이라면 프랑스와 같이 원자력발전의 안전성을 통제하면서 기존 원자로의 수명을 연장하고, 신규 원자력발전소 건설을 용이하게 함으로써 탄소중립을 실현할 수 있도록 입법론적인 검토가 필요가 있다.
Abstract
The IPCC's assessment reports serve as a reminder of the urgency with which we must take swift, comprehensive, long-term, and massive action to keep global warming to 2°C. In order to leave future generations with a habitable Earth, we must make this climate endeavor. It necessitates actions tailored to the problem. The necessity of drastically cutting our greenhouse gas emissions reinforces one another and serves as a timely reminder that action must be taken to begin the process of decarbonization. Thanks to historic energy policy decisions, France will be well ahead of its European neighbors in 2022 when it comes to the decarbonization of its economy. It also has to do with bringing nuclear energy back to life. In this regard, France established the "Act relating to the acceleration of procedures linked to the construction of new nuclear installations near existing nuclear sites and the operation of existing installations(n° 2023-491, 22 June 2023)". Energy planning is updated by the Act. It streamlines the administrative processes involved in building new nuclear reactors. It also covers nuclear security and safety as well as the expansion of outdated power facilities. It is challenging to continue with a nuclear phase-out approach while dealing with the climate catastrophe. Then, as France's legislative example suggests, it need to legislatively review measures to simplify procedures to facilitate the construction of new nuclear power plants on the one hand, and extend the lifespan of existing nuclear reactors while controlling nuclear safety on the other.
