Abstract

As the mobility of the elderly increases, it is not uncommon that the elderly have many opportunities to travel abroad and have habitual residences, domiciles, business establishments, and property in countries other than their home state. Because the elderly get connected with one or more countries, legal issues surrounding conflict of laws of different countries are likely to get involved with regard to their health care, responsibilities for supporting their families, protection of their properties. There have been efforts in the world community to settle the complex issues as to the jurisdiction of competent authorities, applicable law, protective measures when the elderly cannot protect their interests for themselves. In 2000, the Hague Conference on Private International Law to which Korea has been a member state since 1997, adopted the Convention on the International Protection of Adults. Although the Convention does not expressly mention that it covers the protection of the elderly, it is presumed that adults include the elderly. Meanwhile, the United Nations Convention on the Rights of Persons with Disabilities was adopted in 2006 and entered into force in 2008. Korea acceded to the Convention in 2009. The Convention has dealt with economic, social, and cultural rights as well as civil and political rights of persons with disabilities. The Convention is designed to protect the rights of persons with disabilities which include the elderly, because every person reaching the old age is quite likely to get incapacitated mentally or physically. In 2009, the Ministry of Justice of Korea tabled a bill on the civil law reform which contained a proposal for the introduction of 'voluntary guardianship'. Under the current Korean civil law, the intervention of the state is too much for the persons with mental incapacity. The civil law will change its attitudes towards the persons with disabilities when the bill has been approved by the members of the Parliament of Korea. The law will be reformed to respect the autonomy of the persons with mental incapacity including the elderly, and enable them to lead normal lives just as the persons without mental incapacity do. Since the Conflict of Laws in Korea was fully revised in 2001, there are no discussions on the potential revision of the Conflict of Laws for the benefit of the elderly. While the reform bill on civil law is getting more attractions from many different quarters in the Korean society, it seems quite right time to consider revising the Conflict of Laws as well. One of the many ways to revise successfully the Conflict of Laws would be to adopt the Hague Convention of 2000 into the Korean legal system in light of the development of the concept towards the protection of the elderly.
