행정법이 독일법의 영향을 강하게 받고 있지만 행정실무에서는 또 다른 중요한 흐름도 나타나고 있다. 행정정책의 수립과 집행이 미국의 법제도와 학문적 사고에 영향 받아 이루어지는 경향이 증가하고 있다는 점이 그것이다. 이 경우 대륙법계인 한국의 행정법제도에 법체계가 다른 미국의 법제도가 접목되는 현상이 나타나게 된다. 경찰의 실무 역시 다른 행정작용에서와 마찬가지로 미국의 경찰제도 및 운용실태를 참고하고 있고, 경우에 따라서는 이들 제도나 방식에 착안한 경찰작용의 변화가 논의되기도 한다. 이러한 상황에서 미국의 경찰관련 법제도가 올바로 수용되기 위해서는 미국에서의 경찰법체계를 정확하게 이해하는 것이 선행되어야 한다. 이 글은 우리의 경찰행정법에 대응하는 미국의 경찰법체계를 전반적으로 보다 정확하게 이해함에 그 목적이 있다. 미국의 경찰법체계를 이해함에 있어서는 크게 보아 경찰의 조직에 관한 법과 작용에 관한 법에 대한 연구가 필요하겠지만, 여기에서는 작용에 관한 법, 즉 경찰작용법의 연구에 초점을 맞추고 있다. 이 글에서는 주로 미국의 경찰관련 문헌들에서 설명하고 있는 내용들을 토대로 우리 경찰행정법에서의 이론적 틀을 이용하여 미국의 경찰작용법 체계를 개설적으로 고찰하고 있다. 경찰작용법의 법원을 비롯하여 우리 경찰행정법의 핵심적 개념도구들인 임무, 권한, 재량, 비례원칙, 강제 그리고 경찰작용에 대한 구제와 관련하여 미국의 경찰작용법을 분석․검토하고 있다.
Abstract
Though the same can be said with respect to other laws of Korea, administrative law in particular follows the basic structure and theory of German administrative law. Germany's administrative laws and regulations and its most recent theories influence Korean administrative law. But recently the establishment and enforcement of administrative policies of Korea tend to receive much influence to the U.S. system and scholarly consideration. Korea's police administrative law has also received influence from the German theory and system in its establishment and development. However, as with practical application of administrative law, the practical working of the police has much reference to the U.S. police system and its operating realities. In some cases, acceptances of certain systems of the U.S. in Korea are fostered. In such case, we find instances where the Korean policing system based on European law is grafted with a U.S. system. In order to accept U.S. police related legal systems and advanced models correctly, one needs to first properly understand the police law system of the U.S. For the purpose of understanding the police law system of the U.S., concentrated research in the U.S. legal system for police activity must be conducted. In this review, with respect to police activity, comprehensive research on the source of law for police activity, duty and authority of police, police discretion, reasonableness, police use of force, and relief for unlawful police activity is done.
