우리법원은 「법원조직법 제5조의2 제1항」에 따라 “법정의 존엄과 질서유지 및 법원청사의 방호를 위하여 대법원과 각급 법원에 법원보안관리대”를 두고 있다. 이는 헌법상삼권분립의 원칙에 따라 다른 국가권력으로부터 사법부의 기능적 독립성을 보장하기 위하여 법원 자체적인 질서유지기관을 둔 것으로서 사법부 독립의 실질적인 실현수단이라는점에서 중요한 의미를 가진다. 다른 국가의 제도와 비교해보면 헌법상 엄격한 권력분립을 택하고 있는 미국 및 독일에서도 위와 같은 취지에서 오래전부터 자국 법원의 특성에 맞는 고유한 자체 법집행기관들을 가지고 있음을 확인할 수 있다. 이런 기관들을 일반경찰과 구분하여 일명 ‘법원보안국’으로 칭할 수 있을 것이다. 그러나 각국의 ‘법원보안국’들은 조직구성과 운영방식에 있어국가별로 오랜 역사적 배경을 반영하다 보니 각각 다른 형태로 나타나고 있어 이를 통해일관적인 조직의 성격과 기능을 추출하기 어려운 상황이다. 그래서인지 현실적으로 존재함에도 불구하고 ‘법원보안국’의 정체성에 대해 학계에서 그간 진지한 논의가 없는 실정이며,법원 정책결정권자들도 역시 조직의 본질적인 성격과 기능에 대해 고찰하지 아니하고 ‘법원보안국’에 대하여 ‘법원경찰’ 또는 ‘법원경비관리대’ 같은 합당하지 않은 용어들을 혼용하여 쓰고 있는 실정이다. 이에 본 연구는 해외각국의 ‘법원보안국’ 제도를 비교분석하고 이를 통해 조직의 본질적인 정체성을 정립하고 정책적인 발전방향성을 제시하는데 목적이 있으며 향후 본격적인논의를 위한 서론적 고찰이 담긴 정책지향적인 논문이다.
Abstract
In acordance with Article 5-2 (1) of the Court Organization Act, our court has "CourtSecurity Management Ofice" in the Supreme Court and courts at various levels tomaintain the dignity and order of the court and protect the court building. In acordancewith the principle of separation of powers in the Constiution, the court has its ownorder-maintaining agency to ensure the functional independence of the judiciary fromother state powers. Compared to other national systems, it can be sen that the United States andGermany, which chose strict separation of powers under the Constiution, have theirown law enforcement agencies that suit the characteristics of their courts for a long time. To distinguish these instiutions from the general police, they can be caled the so-caled'Court Marshals Bureau'. However, each country’s ‘Court Marshals bureaus’ apear indiferent forms reflecting the long historical background of each country in theirorganizational structure and operation method, making it dificult to extract consistent organizational characteristics and functions. Perhaps that's why despite its realisticexistence, there has ben no serious discusion in academia about the identiy of the"Court Marshals Bureau," and the thoughts of court policy decision makers have notconsidered the esential nature and function of the organization, but only remainsuperficial. Organizational development is stagnant as acidents remain. Therefore, this Constiutional Policy Paper containing introductory consideration aimsto compare and analyze the signifcance of the ‘Court Marshals Bureau’ with the systemsof foreign countries, and sugest the identiy of the instiution and the policyimprovement direction through this.
