Abstract
This study resulted from the unprecedented situation in which the National Assembly's security guard, a member of the administration, blocked lawmakers from entering the National Assembly despite the speaker's order, in a situation where martial law forces entered the National Assembly due to the president's declaration of emergency martial law on December 3, 2024. This incident brings the necessity and justification that in order to protect the constitutional order of the Republic of Korea through the existence and normal functioning of the National Assembly, the National Assembly must strengthen the speaker's command and supervision authority, minimize the intervention of external police agencies, or have an independent police organization to exercise effective police power. The Constitution of the Republic of Korea gives the National Assembly a constitutional status that contrasts clearly with general administrative agencies based on the principle of separation of powers. The National Assembly plays an important role in the state power required by the Constitution, and therefore, it is necessary to secure its own advanced autonomy separate from the executive and judicial branches. The independent establishment of a tentatively named ‘National Assembly Police Force’ could be an option. This is because the police protection law, which protects the function of the National Assembly and guarantees the inviolable autonomy of the National Assembly, clearly exists in the demand for the establishment of such a National Assembly police power, including the right to maintain order and the right to house the National Assembly.
