Abstract

With the development of artificial intelligence technology, the digital welfare state is facing a new opportunity. The use of artificial intelligence in social security administration is mainly aimed at finding blind spots and blocking benefit fraud, and is expected to achieve cost reduction, efficiency, and accuracy. However, this can pose a strong threat to the basic rights by causing the infringement of human dignity and values, personal information and privacy, and right to equality. Accordingly, this paper examines the problems that may arise in digital welfare states using artificial intelligence in social security administration from the perspective of protecting basic rights and suggests normative countermeasures to minimize adverse effects while securing positive effects from the use of artificial intelligence. The use of artificial intelligence in social security administration can be expected to evolve a true digital welfare state when it is aimed at raising the level of social security, addressing the needs of new forms of care and jobs, and strengthening community solidarity. Efforts should be made to solve essential problems such as the causes of blind spots and benefit fraud, supplementing the social security system to meet changes in reality, reviewing entitlement or levels of social security benefits, improving the system to minimize the possibility of duplicate or unfair payments, and strengthening education. Social security is ultimately aimed at realizing human dignity and substantially expanding individual freedom and equality. Innovation through new technologies and the basic rights must be balanced. The goals set by the use of artificial intelligence in digital welfare states should also be achieved while minimizing infringement of basic rights by complying with the rule of law. Specific legal basis for the use of artificial intelligence in social security work should be prepared, excluding the general and comprehensive method of collecting and analyzing personal data, and limiting the data that can be used for analysis and organizations that can share data to the level necessary to achieve the objectives. Various procedural controls are also needed to ensure transparency, accountability, and objectivity.
