산업보안 담당자의 보안정책 준수에 영향을 미치는 요인- 억제이론과 합리적 선택이론을 중심으로 -

초록

우리나라는 추격발전(Catch-up Development)의 과정을 지나 脫 추격시대(Post Catch-up Era)에 접어들면서 산업기술 및 기밀의 유출이 증가하고 있으며, 산업기술 및 기밀의 보호는 기업의 생사를 결정할 정도로 매우 중요하게 되었다. 통계상으로도 산업기술 및 기밀의 유출사례와 그 피해액도 증가하고 있다. 그러나 이에 대한 대응은 아직까지 만족할 만한 수준에 이르지 못하고 있는 실정이다. 그런데 우리나라의 산업기술 및 기밀의 유출은 대부분 전·현직 직원, 즉 내부자에 의해 이루어지고 있다. 이는 해킹이나 외부인의 침입을 강화하는 노력과 함께 내부 직원이 산업기술 및 기밀을 유출하려는 의지를 억제하는 것이 중요함을 의미한다고 할 수 있다. 본 연구에서는 내부직원, 특히 산업보안 담당자들의 보안정책 준수에 영향을 미치는 요인에 대해 범죄학의 억제이론과 합리적 선택이론을 적용하여 살펴보았다. 세부적으로 처벌의 확실성과 엄격성을 처벌에 대한 인식, 특별 억제, 일반 억제로 구분하여 어떠한 요인들이 보안정책 준수에 영향을 미치는 지를 분석하였다. 분석 결과, 확실한 처벌의 특별 억제가 가장 큰 영향을 미치고 있었으며, 그 다음으로는 엄격한 처벌의 특별 억제가 강한 영향을 미쳤다. 이에 따르면 동료나 상사의 처벌은 본인의 보안정책 준수에 큰 영향이 없는 것이다. 즉 주위의 동료가 처벌을 받더라도 그러한 처벌은 자신과는 상관이 없다고 생각하지만, 본인이 처벌을 받을 가능성이 있다면 보다 적극적으로 보안정책을 준수할 것이라는 의미로 해석할 수 있다. 특히, 본 연구에서는 엄격한 처벌보다는 확실한 처벌이 더욱 큰 영향을 미친다는 결과가 나왔으므로, 향후 산업기술 및 기밀 유출자 검거를 위한 전담조직의 확대와 인력의 증원 등과 함께, 기존의 산업기술 및 기밀 유출행위에 대한 처벌도 강화할 필요가 있다.

Abstract

The number of industrial technology leakage has increased and this issue becomes crucial for the survival of companies because Korea entered into the post catch up era after the catch up development stage. The official statistics shows that number of industrial technology leakage and the amount of damage has increased. However, the responses to this issue have not reached the competent level. Many of industrial technology leakage have been committed by current and former employees. It implies that deterrence of insiders’ willingness to commit industrial technology leakage is the key point. This study explored the factors that influence the insiders, especially industrial security officers’ willingness to obey security policies. More specifically, certain punishment, severe punishment, special deterrence, and general deterrence are analyzed. The results of the analysis indicate that certain punishment of special deterrence is the most important factor that influences security officers’ conformity of security rules. Severe punishment of special deterrence also plays important role for security officers to obey security rules. Based on the results, the expansion of law enforcement organization, increase of manpower, and severe punishment on industrial technology leakage are suggested.
